Diese Allgemeinen Geschäftsbedingungen („AGB") regeln das Vertragsverhältnis zwischen Jennifer Zittier Marketing – FZCO („DSM", „wir", „uns") und dem Kunden („Kunde", „Teilnehmer", „Sie") über den Erwerb und die Nutzung des digitalen Bildungsprogramms „Digital Success Mastery" sowie aller damit verbundenen Leistungen.
Digital Success Mastery ist ein umfassendes Online-Schulungsprogramm für digitales Marketing und den Aufbau eines Online-Business. Mit dem Kauf erhalten Sie Zugang zu digitalen Lerninhalten, einer Community und weiteren Ressourcen.
Diese AGB gelten für alle Verträge zwischen DSM und dem Kunden über den Erwerb des Digital Success Mastery Programms, einschließlich aller digitalen Inhalte, Community-Zugänge und Zusatzleistungen.
Entgegenstehende oder abweichende Bedingungen des Kunden werden nicht anerkannt, es sei denn, wir stimmen ihrer Geltung ausdrücklich schriftlich zu.
Gegenstand des Vertrags ist:
Bei Digital Success Mastery handelt es sich um digitale Inhalte, die nicht auf einem körperlichen Datenträger geliefert werden. Die Bereitstellung erfolgt ausschließlich online über unsere Kursplattform.
Die Darstellung des DSM-Programms auf unserer Website stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Abgabe eines Angebots (invitatio ad offerendum).
Mit dem Abschluss des Bestellvorgangs und der Eingabe Ihrer Zahlungsdaten geben Sie ein verbindliches Angebot zum Kauf ab.
Der Vertrag kommt erst mit erfolgreicher Zahlungsabwicklung zustande.
Bei Zahlung per Kreditkarte, PayPal, Klarna oder anderen elektronischen Zahlungsmethoden erfolgt der Vertragsschluss mit der erfolgreichen Autorisierung und Belastung Ihres Zahlungsmittels.
Bei Ratenzahlung kommt der Vertrag mit Einzug der ersten Rate zustande.
Nach erfolgreichem Vertragsschluss erhalten Sie eine Bestätigungs-E-Mail mit Ihren Zugangsdaten zur Kursplattform. Diese E-Mail dient der Information und stellt keine erneute Annahmeerklärung dar.
Sie müssen mindestens 18 Jahre alt sein und uneingeschränkte Geschäftsfähigkeit besitzen.
Sie verpflichten sich, bei der Registrierung wahrheitsgemäße und vollständige Angaben zu machen. Änderungen sind uns unverzüglich mitzuteilen.
DSM umfasst umfangreiche Video-Module, Arbeitsmaterialien, Vorlagen und Ressourcen zum Thema digitales Marketing und Online-Business-Aufbau.
Der genaue Leistungsumfang richtet sich nach dem von Ihnen gewählten Paket und ist auf der Verkaufsseite zum Zeitpunkt des Kaufs beschrieben.
Mit dem Kauf erhalten Sie Zugang zur DSM-Community (über Skool oder JAIV). Der Zugang zur Community ist an die Einhaltung der Community-Regeln (§ 7) gebunden.
Je nach gewähltem Paket können Live-Calls, Q&A-Sessions oder Support-Leistungen enthalten sein. Art und Umfang sind auf der Verkaufsseite beschrieben.
Die Zugangsdauer zu den Kursinhalten richtet sich nach dem gewählten Paket:
Wir behalten uns vor, die Kursinhalte jederzeit zu aktualisieren, zu erweitern oder anzupassen. Ein Anspruch auf bestimmte Inhalte oder deren unveränderte Bereitstellung besteht nicht.

Da Jennifer Zittier Marketing – FZCO in den Vereinigten Arabischen Emiraten ansässig ist, fällt keine deutsche Umsatzsteuer an.

Das Widerrufsrecht erlischt bei digitalen Inhalten, die nicht auf einem körperlichen Datenträger geliefert werden, wenn:
Im Bestellprozess werden Sie aufgefordert, folgende Erklärung durch Setzen einer Checkbox zu bestätigen:
„Ich bestätige, dass ich ausdrücklich verlange, dass die Leistung sofort mit Vertragsschluss beginnt (sofortiger Zugang zu den digitalen Inhalten). Mir ist bekannt, dass ich dadurch mein Widerrufsrecht verliere."
Ohne diese Bestätigung kann der Kauf nicht abgeschlossen werden.
Mit dem Kauf erhalten Sie ein einfaches, nicht ausschließliches, nicht übertragbares Recht zur persönlichen Nutzung der DSM-Inhalte für die Dauer des Zugangs.
Alle Rechte an den Kursinhalten (Videos, Texte, Grafiken, Vorlagen, Materialien) verbleiben bei DSM bzw. Jennifer Zittier. Der Kauf begründet kein Eigentum an den Inhalten.
Ausdrücklich untersagt ist:

Folgendes Verhalten führt zum sofortigen und dauerhaften Ausschluss aus der DSM-Community und kann zum Entzug des Kurszugangs führen, ohne Anspruch auf Rückerstattung:
Bei Ausschluss gemäß § 7.3 besteht kein Anspruch auf Rückerstattung des Kaufpreises oder bereits gezahlter Raten. Offene Ratenzahlungen bleiben fällig.
Wir dokumentieren Verstöße und behalten uns vor, Screenshots und andere Beweise zu sichern.
Wir bemühen uns um eine hohe Verfügbarkeit der Kursplattform. Eine 100%ige Verfügbarkeit können wir jedoch nicht garantieren.
Geplante Wartungsarbeiten werden nach Möglichkeit angekündigt. Sicherheitskritische Updates können jederzeit ohne Vorankündigung durchgeführt werden.
Für die Nutzung von DSM benötigen Sie:
Sie sind selbst für die Erfüllung der technischen Voraussetzungen verantwortlich.
Die DSM-Inhalte und Community werden über Skool und/oder JAIV bereitgestellt. Wir bemühen uns um eine hohe Verfügbarkeit, haften jedoch nicht für Ausfälle oder technische Störungen dieser Plattformen, die außerhalb unserer Kontrolle liegen.

DSM wird "WIE BESEHEN" ohne jegliche ausdrückliche oder stillschweigende Gewährleistung bereitgestellt.

Wir behalten uns vor, diese AGB zu ändern. Änderungen werden Ihnen per E-Mail mitgeteilt.
Für Neukunden gelten automatisch die zum Zeitpunkt des Kaufs gültigen AGB.
Wesentliche Änderungen werden Bestandskunden mit einer Frist von 4 Wochen mitgeteilt. Widersprechen Sie nicht innerhalb von 2 Wochen nach Zugang, gelten die Änderungen als angenommen.
Diese AGB und alle Rechtsbeziehungen zwischen DSM und dem Kunden unterliegen dem Recht der Vereinigten Arabischen Emirate (Dubai).
Die Anwendung des UN-Kaufrechts (CISG) ist ausgeschlossen.
Soweit Sie Verbraucher mit gewöhnlichem Aufenthalt in der Europäischen Union sind, bleiben zwingende Verbraucherschutzvorschriften Ihres Aufenthaltsstaates unberührt, soweit diese Ihnen einen weitergehenden Schutz gewähren.
Ausschließlicher Gerichtsstand für alle Streitigkeiten ist Dubai, Vereinigte Arabische Emirate.
Wir sind jedoch auch berechtigt, Klage am allgemeinen Gerichtsstand des Kunden zu erheben.
Die Vertragssprache für Kunden aus Deutschland, Österreich und der Schweiz ist Deutsch. Für Kunden aus anderen Ländern ist die Vertragssprache Englisch.
Bei Widersprüchen zwischen den Sprachversionen gilt für deutschsprachige Kunden die deutsche Fassung.
Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
Änderungen oder Ergänzungen dieser AGB bedürfen der Textform.

Wir sind nicht bereit oder verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.

Ich verstehe, dass keine Rückerstattung erfolgt.
Ich verstehe, dass Verstöße gegen die Community-Regeln (§ 7) zum Ausschluss ohne Rückerstattung führen können.
Ich verpflichte mich zur Einhaltung aller geltenden Gesetze.

These Terms and Conditions ("Terms") govern the contractual relationship between Jennifer Zittier Marketing – FZCO ("DSM," "we," "us") and the customer ("Customer," "Participant," "you") regarding the acquisition and use of the digital education program "Digital Success Mastery" and all related services.
Digital Success Mastery is a comprehensive online training program for digital marketing and building an online business. With your purchase, you receive access to digital learning content, a community, and additional resources.
These Terms apply to all contracts between DSM and the Customer regarding the acquisition of the Digital Success Mastery program, including all digital content, community access, and additional services.
Conflicting or deviating terms of the Customer are not recognized unless we expressly agree to their validity in writing.
The subject matter of the contract is:
Digital Success Mastery is digital content that is not delivered on a physical medium. Delivery is exclusively online via our course platform.
The presentation of the DSM program on our website does not constitute a legally binding offer but rather a non-binding invitation to submit an offer (invitatio ad offerendum).
By completing the checkout process and entering your payment information, you submit a binding offer to purchase.
The contract is only concluded upon successful payment processing.
For payments via credit card, PayPal, Klarna, or other electronic payment methods, the contract is concluded upon successful authorization and charging of your payment method.
For installment payments, the contract is concluded upon collection of the first installment.
After successful contract conclusion, you will receive a confirmation email with your login credentials for the course platform. This email is for informational purposes and does not constitute a new acceptance.
You must be at least 18 years old and have full legal capacity.
You agree to provide truthful and complete information during registration. Any changes must be communicated to us immediately.
DSM includes extensive video modules, working materials, templates, and resources on digital marketing and online business development.
The exact scope of services depends on the package you choose and is described on the sales page at the time of purchase.
With your purchase, you receive access to the DSM Community (via Skool or JAIV). Access to the community is contingent upon compliance with the Community Rules (§ 7).
Depending on the package chosen, live calls, Q&A sessions, or support services may be included. The type and scope are described on the sales page.
The duration of access to the course content depends on the package chosen:
We reserve the right to update, expand, or modify the course content at any time. There is no entitlement to specific content or its unchanged provision.

All rights to course content (videos, texts, graphics, templates, materials) remain with DSM or Jennifer Zittier. The purchase does not establish ownership of the content.

The following behavior leads to immediate and permanent exclusion from the DSM Community and may result in revocation of course access, without entitlement to refund:
In case of exclusion pursuant to § 7.3, there is no entitlement to refund of the purchase price or installments already paid. Outstanding installment payments remain due.
We document violations and reserve the right to save screenshots and other evidence.
We strive for high availability of the course platform. However, we cannot guarantee 100% availability.
Scheduled maintenance will be announced whenever possible. Security-critical updates may be performed at any time without notice.

For one-time payments or during ongoing installment payments, there is no ordinary right of termination. The purchase contract is binding upon contract conclusion.

For new customers, the Terms valid at the time of purchase automatically apply.
Material changes will be communicated to existing customers with 4 weeks' notice. If you do not object within 2 weeks of receipt, the changes are deemed accepted.
These Terms and all legal relationships between DSM and the Customer are governed by the laws of the United Arab Emirates (Dubai).
The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
To the extent you are a consumer with habitual residence in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected insofar as they provide you with greater protection.
The exclusive place of jurisdiction for all disputes is Dubai, United Arab Emirates.
However, we are also entitled to bring action at the general place of jurisdiction of the Customer.
The contract language for customers from Germany, Austria, and Switzerland is German. For customers from other countries, the contract language is English.
In case of discrepancies between language versions, the German version applies for German-speaking customers.
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
Amendments or additions to these Terms require text form.

We are not willing or obligated to participate in dispute resolution proceedings before a consumer arbitration board.
